GDPR for Job and Collaboration Candidates

Dear Sirs/Madams,
By submitting a proposal for collaboration, you provide us with your personal data, thereby acknowledging the following principles regarding its processing. We will process your data only in a lawful manner, ensuring its confidentiality, proper protection, and integrity. In the following information, we want to indicate the purposes for which we will process your data, the types and scope of personal data we collect, use, and process, as well as inform you of your rights.
According to the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data (the "GDPR"), and repealing Directive 95/46/EC, the controller of your personal data will be Respekt Personal Group Sp. z o.o. Being a data controller means, among other things, that we are responsible for processing the personal data we receive in connection with the recruitment process and potential future employment.

Do you have to provide your data, and which data do we use?
Providing the personal data we ask for, such as name, education, date of birth, place of residence, employment history, and, in the case of foreigners, passport, PESEL number, diplomas, is necessary to participate in the recruitment process and results from applicable legal regulations, as well as the ability to obtain the right to reside and work in the territory of the Republic of Poland if obtaining such rights is necessary for you. We will process additional personal data based on your voluntary consent, which you express by sending us your recruitment application. However, remember that providing additional data does not affect the ability to participate in the recruitment process. If you do not want us to process these data, please do not include them in your documents. If you would like us to keep your offer and data in our database, please also provide a statement expressing such consent, preferably with the following wording: "I consent to the processing by Respekt Personal Group Sp. z o.o. of my personal data contained in my submitted recruitment application for future recruitment purposes" or another with the same meaning.
We will never ask you to provide us with personal data related to racial or ethnic origin, political views, religious or philosophical beliefs, trade union membership, genetic data, or sexual orientation, unless such an obligation results from applicable legal regulations.
For what purpose will we process your personal data?
We will process your personal data, among other things:
  • For recruitment needs (Art. 6, Section 1, Letter b of the GDPR),
  • To take actions leading to an agreement with us (Art. 6, Section 1, Letter b, Art. 6, Section 1, Letter a of the GDPR),
  • To fulfill a legal obligation, including legalizing your residence and work in Poland (Art. 6, Section 1, Letter c of the GDPR).
In connection with processing data for the purposes mentioned above, your data may be transferred to other entities authorized to access your personal data based on relevant legal regulations, as well as entities providing services to the Data Controller related to our operations, such as HR, legal, or IT service providers.
Your personal data will be processed by us only during the recruitment process (and possible future processes if you consent to process your data for future recruitment purposes, but no longer than one year). After that, your data will be retained for the time necessary to secure and pursue any potential claims, and in case of withdrawal of consent to process personal data or lodging an objection, until the consent is withdrawn or the objection is lodged. Your personal data will not be used for automated decision-making, including profiling.
What rights do you have, and how can you exercise them?
Under applicable regulations, you have the following rights:
  • The right to access – you have the right to obtain information regarding the processing of your personal data and a copy of such data.
  • The right to correct – if you believe that we are processing your personal data inaccurately or incompletely, you may request appropriate changes.
  • The right to delete – you can request the deletion of your personal data within the limits allowed by law.
  • The right to limit processing – you can request a limitation on processing your personal data.
  • The right to object – you can object to the processing of your personal data for reasons related to your situation. You have an absolute right to object when personal data are processed for direct marketing purposes.
  • The right to withdraw consent – if processing your personal data is based on consent, you can withdraw your consent at any time, within legal limits. Please note that withdrawing consent will not affect the validity of processing operations performed before its withdrawal.
  • The right to data portability – if legally allowed and feasible, you can request your personal data to be returned to you or transferred to a third party.
According to applicable regulations, you also have the right to file a complaint with the relevant supervisory authority – the President of the Office for Personal Data Protection.
